It means a person who has the right on the property by his birth. In such cases, the property will devolve according to the will of the deceased.<\/li><\/ol>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Intestate succession: &#8211; <\/strong>Intestate succession means the distribution of the property of the person who has died without leaving a valid and enforceable will behind. Because of this succession, the real owner of the property can be easily known. In this succession, the court has decided the process to distribute the property of a person after his\/her death and who can claim his\/her rights against the property.<\/li><\/ul>\n\n\n\n<p>For example, a person dies without disposing off his property, then according to the intestate succession, he shall pass on the right of property from one person to another.<\/p>\n\n\n\n<p><strong>Section 3 of Hindu Succession act: &#8211; <\/strong>There are certain definitions mentioned in this section, such as:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"a\"><li><strong>Agnates:<\/strong> &#8211; It means that a person who is wholly related through males.<\/li><li><strong>&nbsp;Cognates:<\/strong> &#8211; Cognates means that a person who is not wholly related through males.<\/li><li><strong>Custom and Usage:<\/strong> &#8211; \u201cCustom\u201d and \u201cusage\u201d under Codified&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <a href=\"https:\/\/www.centurylawfirm.in\/blog\/hindu-vs-muslim-law-comprehensive-guide-to-marriage-divorce-adoption-and-succession-in-india\/\" data-internallinksmanager029f6b8e52c=\"139\" title=\"Hindu vs Muslim Law: Comprehensive Guide to Marriage, Divorce, Adoption and Succession in India\">Hindu Law<\/a>: Under the codified <a href=\"https:\/\/www.centurylawfirm.in\/blog\/hindu-vs-muslim-law-comprehensive-guide-to-marriage-divorce-adoption-and-succession-in-india\/\" data-internallinksmanager029f6b8e52c=\"139\" title=\"Hindu vs Muslim Law: Comprehensive Guide to Marriage, Divorce, Adoption and Succession in India\">Hindu Law<\/a>, the words \u201ccustom\u201d and \u201cusage\u201d are defined to suggest any rule which, having been continuously and uniformly observed for a long time, has obtained the force of law among Hindus in any local range, tribe, community, group or family.<\/li><li><strong>Full blood, half blood and uterine blood: &#8211; <\/strong>Full blood are the&nbsp;&nbsp; children who have the same parents.<\/li><\/ol>\n\n\n\n<p>Half-blood relation means where there is one father but different mothers.<\/p>\n\n\n\n<p>Uterine blood means where mother is same and fathers are different.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Heir: &#8211; <\/strong>Heir means that a person who is legally entitled to the property when the deceased person did not formalise a last will or <a href=\"https:\/\/www.centurylawfirm.in\/blog\/will\/\" data-internallinksmanager029f6b8e52c=\"71\" title=\"Will Registration in Delhi - Expert Legal Assistance | Century Law Firm\">testament<\/a>.<\/li><li><strong>Intestate: &#8211; <\/strong>Intestate means that when a person dies without leaving any instructions about who should receive the property.<\/li><\/ul>\n\n\n\n<p><strong>Section 8 of intestate succession for males: &#8211; <\/strong>This section is related with the general rule of succession in the case of males and there are many provisions where the property can be divided after dying intestate accordingly.<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"a\"><li><strong>Class I heirs: &#8211;<\/strong><\/li><\/ol>\n\n\n\n<p>The property is distributed simultaneously and father has no role in this class. Class I heir is classified as;<\/p>\n\n\n\n<p>Son, daughter, widow, mother, son of a pre-deceased son, daughter of a pre-deceased son, son of a pre-deceased daughter, daughter of a pre-deceased daughter, widow of a pre-deceased son, son of a pre-deceased son of a pre-deceased son, daughter of a pre-deceased of a pre-deceased son, widow of a pre-deceased son of a pre-deceased son.<\/p>\n\n\n\n<p>(Explanation: &#8211; In case of illegitimate son\u2019s property only the mother can hire the property and not father).<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Class II heirs: &#8211;<\/strong><\/li><\/ul>\n\n\n\n<p>The preference is given to the father in class II heirs and the property is divided sequence wise such as;<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"I\"><li>Father<\/li><li>1) Son\u2019s daughter\u2019s son, 2) Son\u2019s daughter\u2019s daughter, 3) Brother, 4) Sister.<\/li><li>1) Daughter\u2019s son\u2019s son, 2) Daughter\u2019s son\u2019s daughter, 3) Daughter\u2019s daughter\u2019s son, 4) Daughter\u2019s daughter\u2019s daughter.<\/li><li>1) Brother\u2019s son, 2) Sister\u2019s son, 3) Brother\u2019s daughter, 4) Sister\u2019s daughter.<\/li><li>Father\u2019s father, Father\u2019s mother.<\/li><li>Father\u2019s widow, Brother\u2019s widow.<\/li><li>Father\u2019s brother, Father\u2019s sister.<\/li><li>Mother\u2019s father, Mother\u2019s mother.<\/li><li>Mother\u2019s brother, Mother\u2019s sister.<\/li><\/ol>\n\n\n\n<p>(Explanation: &#8211; In this schedule, references of full &amp; half-blood relations (brother and sister) do not include references to a brother or sister by uterine blood).<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Agnates:<\/strong> &#8211; It means that a person who is wholly related through males.<\/li><\/ul>\n\n\n\n<p>(Explanation: &#8211; Widows are not included because of marriage and uterine blood is also not recognized).<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Cognates:<\/strong> &#8211; Cognates means that a person who is not related with, wholly through males.<\/li><\/ul>\n\n\n\n<p>(Explanation: &#8211; It is not based on marriage and depends on only on blood &amp; <a href=\"https:\/\/www.centurylawfirm.in\/blog\/adoption-procedure-in-india\/\" data-internallinksmanager029f6b8e52c=\"29\" title=\"Adoption Procedure in India Under the New Juvenile Justice Act\">adoption<\/a> relations).<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Escheat: &#8211; <\/strong>When a person dies an intestate and has left no heir qualified to succeed to his or her property, then the government takes over that property.<\/li><\/ul>\n\n\n\n<p><strong>Section 14 of Hindu succession act: &#8211;<\/strong><\/p>\n\n\n\n<p>This section provides absolute ownership to females.<\/p>\n\n\n\n<p><strong>Section 15 of Intestate Succession for females: &#8211; <\/strong>This section relates with the general rule of succession in case of female Hindus. If a female dies an intestate then property will devolve like;<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"a\"><li>Firstly, upon the sons and daughters(including the children of any pre-deceased son or daughter) and the husband;<\/li><li>Secondly, upon the heirs of the husband;<\/li><li>Thirdly, upon the mother and father;<\/li><li>Fourthly, upon the heirs of the father; and<\/li><li>Lastly, upon the heirs of the mother.<\/li><\/ol>\n\n\n\n<p>For instance; a married woman has been gifted a property by her parents and thereafter, she dies without disposing of the property and she has no child or pre-deceased child.
