Statutory references are to the Acts as in force on that date.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Bail in a matrimonial case: the law and the Delhi practice<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">The usual charges<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Section 85 BNS (formerly 498A IPC)<\/strong> \u2013 cruelty by husband or relatives: up to three years and fine; cognizable, non-bailable, non-compoundable, triable by a Magistrate of the first class.<\/li>\n\n\n<li><strong>Section 316(2) BNS (formerly 406 IPC)<\/strong> \u2013 criminal breach of trust, used for non-return of <em>stridhan<\/em>; up to three years, cognizable, non-bailable.<\/li>\n\n\n<li><strong>Sections 3 and 4, Dowry Prohibition Act, 1961<\/strong> \u2013 giving or taking dowry (minimum five years) and demanding dowry (six months to two years); non-bailable.<\/li>\n\n\n<li><strong>Section 80 BNS (formerly 304B IPC)<\/strong> \u2013 dowry death, where the wife dies within seven years of marriage in unnatural circumstances after cruelty for dowry: minimum seven years, triable by a Court of Session. Breach invites departmental action and contempt.<\/li>\n\n\n<li><strong>Delhi&#8217;s pre-FIR process.<\/strong> Complaints under Section 498A are first sent to the Crime Against Women (CAW) Cell of the district for counselling and conciliation; an FIR is registered only if that fails (Delhi High Court, <em>Chander Bhan v. State<\/em>, 2008, and Delhi Police standing orders). This stage is the best opportunity to settle or to narrow the allegations.<\/li>\n\n\n<li><strong>Over-implication of relatives.<\/strong> The Supreme Court has repeatedly quashed or granted bail where married sisters-in-law, elderly parents-in-law or relatives living elsewhere are named on general allegations \u2013 <em>Preeti Gupta v. State of Jharkhand<\/em> (2010), <em>Kahkashan Kausar v. State of Bihar<\/em> (2022), <em>Dara Lakshmi Narayana v. State of Telangana<\/em> (2024).<\/li>\n\n\n<li><strong>Anticipatory bail (Section 482 BNSS, formerly 438 CrPC)<\/strong> is routinely granted to parents-in-law and distant relatives, and to husbands who join the investigation and show willingness to return <em>stridhan<\/em>; interim protection is commonly given on the first hearing before the Sessions Court.<\/li>\n\n\n<li><strong><a href=\"https:\/\/www.centurylawfirm.in\/blog\/regular-bail-in-criminal-case\/\">Regular bail<\/a><\/strong> for Section 85\/316(2) offences is granted by the Magistrate, usually on the first or second date once the accused has been interrogated, since the offences carry up to three years and custodial interrogation is rarely needed. Typical conditions: do not contact the complainant or her family, do not leave the country, join investigation, return articles listed in the FIR.<\/li>\n\n\n<li><strong>Settlement and quashing.<\/strong> Although Section 498A is non-compoundable, the High Court quashes the FIR on a genuine settlement under Section 528 BNSS (formerly 482 CrPC) following <em>B.S. Joshi v. State of Haryana<\/em> (2003) and <em>Gian Singh v.
