The argument was that because the land was not occupied by a settled society with a recognizable system of government and laws, it could be claimed by European powers as their own.<\/p>\n\n\n\n<p>However, the concept of &#8220;terra nullius&#8221; has been criticized by many as a legal fiction that has been used to justify the dispossession of indigenous peoples from their traditional lands. In many cases, the lands claimed as &#8220;terra nullius&#8221; were in fact inhabited by indigenous peoples who had their own systems of government, law and culture, and who had been living on those lands for generations.<\/p>\n\n\n\n<p>The use of the concept of &#8220;terra nullius&#8221; has been largely discredited in modern international law, which recognizes the rights of indigenous peoples to their traditional lands and resources. Today, the principles of self-determination and the recognition of the rights of indigenous peoples are widely accepted as fundamental principles of international law.<\/p>\n\n\n\n<p>Overall, &#8220;terra nullius&#8221; is an important legal term that reflects the history of colonialism and the dispossession of indigenous peoples from their traditional lands.
