This can include a direct personal interest, such as a property owner’s right to challenge a zoning decision that affects their property, or a broader public interest, such as a citizen’s right to challenge a law that they believe is unconstitutional.

The concept of locus standi is important because it helps to ensure that the courts are not overwhelmed with frivolous or meritless claims. By requiring parties to have a sufficient interest or stake in the outcome of a case, the courts can focus their resources on resolving disputes that are truly important and relevant to the parties involved.

Overall, locus standi is an important legal term that reflects the need for parties to have a legitimate interest or stake in the outcome of a case in order to bring it before a court. By ensuring that the parties involved have a sufficient interest in the case, the courts can focus their efforts on resolving disputes that truly matter, while avoiding frivolous or meritless claims that waste time and resources.

Reviewed and updated by Century Law Firm, Delhi – October 2026. The traditional rule, still applied in private litigation, is that only a “person aggrieved” – someone whose legal right or interest is directly affected – may sue, appeal or petition. Indian public law relaxed this rule dramatically from 1981 onwards:

The strict rule. A civil suit must be brought by the person whose right is infringed (Order I CPC); a writ petition under Article 226 for a private grievance must be by the person affected; appeals lie only at the instance of a party aggrieved by the decree (Adi Pherozshah Gandhi v. H.M. Seervai, 1970, on the meaning of “person aggrieved”).

Public interest litigation. In S.P. Gupta v. Union of India (1981) the Supreme Court held that any member of the public acting bona fide may approach the court on behalf of persons who, because of poverty, disability or social disadvantage, cannot approach it themselves, and in People’s Union for Democratic Rights v. Union of India (1982) and Bandhua Mukti Morcha (1984) it entertained letters and petitions by organisations on behalf of workers and bonded labourers.

Limits on the relaxed rule. The petitioner must have no personal or political axe to grind; “publicity interest” and “private interest” litigation masquerading as PIL is dismissed, often with costs (Ashok Kumar Pandey v. State of W.B., 2004; State of Uttaranchal v. Balwant Singh Chaufal, 2010, which lists the conditions courts apply).

Statutory standing. Some statutes define who may complain: for example only the aggrieved woman or her relatives may set the Muslim Women (Protection of Rights on Marriage) Act, 2019 in motion; only a “consumer” (or a recognised consumer association) may file a consumer complaint; and only an “aggrieved person” may apply under Section 12 of the Domestic Violence Act. A stranger lacks standing under these Acts however genuine his concern.

Victims in criminal cases. The victim now has standing to appeal against acquittal or inadequate sentence under the proviso to Section 413 BNSS (formerly 372 CrPC), and may engage a lawyer to assist the prosecution (Section 338 BNSS, formerly 301).

Standing is examined at the threshold, so a petition should state in its opening paragraphs who the petitioner is and how he is affected or why he is entitled to speak for others.
