How these court fee calculators work
In most civil suits for money, damages or recovery of property, the court fee is ad valorem: it depends on the value of the suit. Each state sets its own scale, either by amending the Court Fees Act, 1870 or through its own court fees law, which is why the fee for the same claim is different from state to state. Enter the value of your suit in rupees and the calculator for your state applies that state’s scale.
Under Section 7(i) of the Court Fees Act, 1870, a suit for money, including damages or compensation, is valued according to the amount claimed. Other kinds of suits, petitions and applications are valued differently or carry a fixed fee, so this calculator is meant for suits where the fee depends on the value.
Before you pay the court fee
Court fee scales are revised from time to time. Please confirm the fee with the court registry, or with your advocate, before filing, and pay it in the form your court accepts. For suits in Delhi you can also see which court will hear the suit on our Delhi court fee and jurisdiction calculator.
Frequently asked questions
What is ad valorem court fee?
Ad valorem means “according to value”. An ad valorem court fee is worked out as a percentage, or a slab, of the value of the suit, so a larger claim pays a larger fee, unlike a fixed fee which stays the same whatever the value.
How do I calculate court fee for a money recovery suit?
Under Section 7(i) of the Court Fees Act, 1870, a suit for money is valued at the amount claimed. Enter that amount in the calculator for your state and it shows the court fee under that state’s scale.
Why is court fee different in each state?
Court fees are fixed by each state. Some states have amended the Court Fees Act, 1870 and others have their own court fees law, so the slabs, percentages and caps are different.
Is court fee refunded if the case is settled?
Under Section 16 of the Court Fees Act, 1870, when the court refers the parties to one of the modes of settlement in Section 89 of the Code of Civil Procedure (arbitration, conciliation, mediation, judicial settlement or Lok Adalat), the plaintiff is entitled to a certificate to receive back the full court fee paid. States can have their own rules, so check the law of your state. Read more about court fee refund in Delhi.
