Delhi civil court fee: how it is worked out

For a civil suit in Delhi the court fee is ad valorem: it rises in slabs with the value of the suit. Up to Rs. 50,000 the scale has several small slabs; above Rs. 50,000 the fee is Rs. 2,832 plus Rs. 48.80 for every Rs. 5,000 or part of it, which is close to one per cent. The table shows what the calculator gives for common values, and which court hears the suit.

Which court in Delhi will hear your civil suit

In Delhi, a civil suit valued up to Rs. 3 lakh goes to the Senior Civil Judge, as the calculator shows; above Rs. 3 lakh and up to Rs. 2 crore to the District Judge; and above Rs. 2 crore on the original side of the Delhi High Court, under the Delhi High Court (Amendment) Act, 2015. An increase of the Civil Judge limit to Rs. 20 lakh has been proposed by the Delhi High Court, but the district courts’ own civil jurisdiction documents (for example South West District, September 2026) still show Rs. 3 lakh.

Commercial disputes of a specified value of Rs. 3 lakh or more go to the Commercial Courts under the Commercial Courts Act, 2015. The court complex depends on where the cause of action arose or where the defendant lives or works: find your court in Delhi by police station.

Consumer complaint fee and which Consumer Commission

A consumer complaint is valued by the price paid for the goods or services, not by the compensation claimed. The fee below is the scale in rule 7 of the Consumer Protection (Consumer Disputes Redressal Commissions) Rules, 2020, as substituted on 17 August 2023, and the Commission is fixed by the Consumer Protection (Jurisdiction of the District Commission, the State Commission and the National Commission) Rules, 2021.

DRT court fee for OA and SA

For an Original Application (OA) by a bank or financial institution for recovery of debt, rule 7 of the Debts Recovery Tribunal (Procedure) Rules, 1993 fixes the fee at Rs. 12,000 where the debt is up to Rs. 10 lakh, and Rs. 12,000 plus Rs. 1,000 for every lakh or part of a lakh above Rs. 10 lakh, up to a maximum of Rs. 1,50,000.

For a Securitisation Application (SA) under Section 17 of the SARFAESI Act, the calculators apply this scale: a borrower pays Rs. 500 for every lakh or part of a lakh up to Rs. 10 lakh, and above that Rs. 5,000 plus Rs. 250 for every further lakh, up to Rs. 1,00,000; any other aggrieved person pays Rs. 125 for every lakh up to Rs. 10 lakh, and above that Rs. 1,250 plus Rs. 125 for every further lakh, up to Rs. 50,000.

Limitation calculator: counting days

The limitation calculator counts the days between two dates, or gives the date a number of days after a starting date. Under Section 12(1) of the Limitation Act, 1963 the day from which the period is to be reckoned is left out, and under Section 4, if the period ends on a day the court is closed, the case can be filed on the day it reopens. No. Since the 2023 amendment of the Consumer Commission rules, no fee is payable where the price paid for the goods or services is up to Rs. 5 lakh. For Rs. 8 lakh the fee is Rs. 200.

What is the DRT fee for an Original Application of Rs. 50 lakh?

Rs. 12,000 for the first Rs. 10 lakh plus Rs. 1,000 for each of the next 40 lakh, that is Rs. 52,000.

Is court fee refunded if the case is settled?

Under Section 16 of the Court Fees Act, 1870, when the court refers the parties to one of the modes of settlement in Section 89 of the Code of Civil Procedure (arbitration, conciliation, mediation, judicial settlement or Lok Adalat), the plaintiff is entitled to a certificate to receive back the full court fee paid.
